Terms of Service

1. Agreement to Terms

By accessing or using the 4fleet chauffeur management platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by BuildFlow Angelika Kotarba ("Service Provider", "we", "our", or "us"), a sole proprietorship registered in the Republic of Poland (NIP: 6711821792, REGON: 364919712, registered office: ul. 1 Maja 13/1, 78-100 Kołobrzeg, Poland). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including visitors, registered users, and paying subscribers.

2. Description of Service

4fleet provides a cloud-based software platform for chauffeur and limousine businesses to manage bookings, fleet, drivers, invoicing, and related operations. The Service includes AI-powered features, integrations with third-party services, and mobile applications.

3. Account Registration

To use the Service, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

4. Subscription and Billing

Free Trial: New accounts receive a 7-day free trial with full access to features. No credit card is required to start the trial.

Subscription Plans: After the trial, you must subscribe to a paid plan to continue using the Service. Subscription fees are billed monthly or annually in advance.

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

Price Changes: We may change subscription prices with 30 days' notice. Continued use after the price change constitutes acceptance.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to systems
• Interfere with or disrupt the Service
• Resell or redistribute the Service without authorization
• Use automated means to access the Service (except approved APIs)

6. Your Data

Ownership: You retain ownership of all data you input into the Service. We do not claim ownership of your business data.

License: You grant us a limited license to use your data solely to provide and improve the Service.

Backup: While we maintain regular backups, you are responsible for maintaining your own backups of critical data.

Export: You may export your data at any time through the platform or by contacting support.

7. AI Features

The Service includes AI-powered features for quotes, suggestions, and analytics. AI outputs are provided as recommendations only. You are responsible for reviewing and approving all AI-generated content before use. We do not guarantee the accuracy of AI outputs.

8. Third-Party Integrations

The Service integrates with third-party services (Stripe, Google Maps, email providers). Your use of these integrations is subject to their respective terms of service. We are not responsible for the operation or availability of third-party services.

9. Intellectual Property

The Service, including its software, design, features, and content, is owned by BuildFlow Angelika Kotarba and protected by intellectual property laws. The "4fleet" name and brand are owned by BuildFlow Angelika Kotarba. You may not copy, modify, distribute, or create derivative works without our written permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. YOU USE THE SERVICE AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILDFLOW ANGELIKA KOTARBA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless BuildFlow Angelika Kotarba and its representatives, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason with notice. Upon termination, your right to use the Service ceases immediately. We will provide reasonable opportunity to export your data before deletion.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the Republic of Poland. Any disputes shall be resolved in the competent Polish courts having jurisdiction over the Service Provider's registered office, unless otherwise required by mandatory consumer protection laws in your jurisdiction (including, for EU consumers, the applicable laws of the member state of your habitual residence).
